Managing Ill and Injured Workers: How to Keep Employees Out of The Bermuda Triangle
Interplay between Worker’s Comp, Leave Laws and the Americans with Disabilities Act. February 11, 2010 1:30 PM - 3:00 PM
When a worker is out ill or injured at work, there are at least four types of federal and state statutes that potentially apply: the Americans With Disabilities Act and similar state laws, the Federal Family Medical Leave Act, state leave and acts and Workers’ Compensation statutes. In addition, many employers have other leave policies in their handbooks which may allow an employee additional leave beyond those granted in state and federal statutes. All of these statutes and policies must be taken into consideration anytime a worker is off work, whether injured off the job or on the job. This presentation will focus on injured/ill employees and their rights to leave time, benefits, and reinstatement upon return.
You will learn: What leaves are required by law? What leave is allowed by company policies? Do benefits continue during leave? For how long? Which ones? Can the Company seek repayment if the employee quits? What reinstatement or re-employment rights does the employee have? What if there are both workers’ compensation injuries and a non-work related injury or illness? This webinar will answer these tough questions.
Faculty: Clay Creps represents employers, both in litigation and through counseling employers. The chair of the Employment Law Practice Group at Bullivant Houser Bailey, he has extensive experience litigating employment-related claims in both federal and state courts, with a particular focus on representing employers in Americans with Disabilities Act litigation. He has taken numerous cases to trial on employment issues, obtaining a high percentage of defense verdicts. He recently won a defense verdict in an ADA trial representing an international insurance company. Clay has litigated cases involving all aspects of employment law including discrimination, harassment, wage and overtime claims, severance agreements, non-compete agreements, the Older Worker Benefit Protection Act (OWBPA), COBRA, FMLA/OFLA, defamation and wrongful discharge. He also assists in matters related to the Lilly Ledbetter Fair Pay Act (LLFPA).

Top Ten Ways to Avoid Getting Sued by Employees February 23, 2010 1:30 PM - 3:00 PM
Employees are suing their employers in record numbers as a result of layoffs, terminations and the tough economic climate. They may sue for harassment or discrimination, wrongful discharge, intentional or negligent infliction of emotional distress, outrageous conduct, assault and battery, defamation, invasion of privacy, and interference with contract or prospective business advantage. Contractors can claim they were really employees, assert wage claims and seek benefits. Employees leave and take with them confidential information and go to a competitor in violation of their obligations or contracts.
The most important key to avoiding such employment law claims is a top-notch risk management program. Employers must have in place: Good policies and procedures that are enforced uniformly and are known to the employees; well-trained and experienced managers and supervisors who will properly manage employee relations; and a responsive and well-trained human resources staff or resources. This seminar will provide employers with the proper tools to reduce their risk of litigation.
Faculty: Chrys Martin's practice focuses on employment law and employee benefits from the management perspective. She represents many health care professionals and medical practices. Her prior experience in human resources and management allows for practical advice to clients faced with complex employment issues.
