Managing Ill and Injured Workers: How to Keep Employees out of the Bermuda Triangle
Interplay between Workers’ Comp, Leave Laws and the Americans with Disabilities Act
When a worker is out ill or injured at work, there are at least four types of federal and state statutes that potentially apply: the Americans With Disabilities Act and similar state laws, the Federal Family Medical Leave Act, state leave acts and Workers’ Compensation statutes. In addition, many employers have other leave policies in their handbooks which may allow an employee additional leave beyond those granted in state and federal statutes. All of these statutes and policies must be taken into consideration any time a worker is off work, whether injured off the job or on the job. This presentation focuses on injured/ill employees and their rights to leave time, benefits, and reinstatement upon return.

OCR Audit Program
OCR announced the formal OCR audit program will be launched by the end of 2011 or the beginning of 2012. At this time OCR is conducting 20 audits to test audit tools and identified audit criteria. After the audit program is launched, KPMG is on contract with OCR to conduct audits of small to large covered entities and business associates. If the audit identifies significant compliance issues, formal enforcement (civil penalties or monetary settlements and/or required compliance with a formal corrective action plan) is likely.

Risk Analysis and Meaningful Use
This webinar will provide a review of the HIPAA Security Rule and the Meaningful Use Rule risk analysis requirements. A risk analysis is more than an examination of risks to your EHR, practice management system and forms of technology you use on a day-to-day basis. A risk analysis must cover risks that may impact your practice at all levels. This includes administrative, physical and technical risks to all PHI, critical business processes and so forth. While the HIPAA Security Rule only focuses on electronic PHI, the HIPAA Privacy Rule includes language requiring you to protect PHI in any form.
This workshop will assist you in developing a plan to conduct your risk analysis on a periodic basis, inventory your “assets,” determine what can harm you and your patients, what controls have you implemented to protect you and your patients and what remaining risks need to be addressed. This includes prioritizing risks, developing mitigation plans and documenting risks that are acceptable to your practice.

Recovery Audit Contractor (RAC) Program
Recovery Audit Contractor Educational Webinar
The RAC program, which is part of the Medicare Modernization Act, seeks to identify and recoup Medicare underpayments and overpayments. To accomplish this goal, CMS has engaged private Recovery Audit Contractors for each region of the country. Oregon is part of Region D and Oregon’s RAC is HealthDataInsight, Inc (HDI). The program recently began to roll out across the country and reached Oregon in fall 2009, when hospitals began receiving RAC inquiries. Physicians are now hearing from the RAC.
